Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using the services (hereinafter referred to as "the Services") provided by Å - ångström (hereinafter referred to as "the Site") on this website. All users (hereinafter referred to as "Users") shall use the Services in accordance with these Terms.

[ Article 1 ] Application

These Terms shall apply to all relationships related to the use of the Services between the User and the Site.
In addition to these Terms, the Site may establish various stipulations, such as rules for use (hereinafter referred to as "Individual Provisions"), regarding the Services.
Regardless of their name, these Individual Provisions shall constitute part of these Terms.
If the provisions of these Terms conflict with the provisions of the Individual Provisions in the preceding paragraph, the provisions of the Individual Provisions shall prevail, unless otherwise specifically stipulated in the Individual Provisions.

[ Article 2 ] Service Fees and Payment Methods

Users shall pay the sales price displayed on this website and separately determined by the Site, as consideration for the purchase of products in the Services, by the method specified by the Site.

[ Article 3 ] Product Purchase

A sales contract for products within the Services shall be established when the User applies to purchase a product through the Site, the Site accepts the application, issues an invoice notification to the User that includes the finalized shipping fee, and the payment is made.
The User, in principle, may not cancel a purchase application after submission, except in cases separately determined by the Site.
Returns and exchanges of products shall only be accepted in cases where the product is defective or a different product from the order has been delivered. The User must contact the Site within a period separately determined by the Site after receiving the product. No returns, exchanges, or cancellations for customer convenience will be accepted outside of these circumstances.
Shipping costs for returns and exchanges in the preceding paragraph shall be borne by the Site due to an error on the part of the Site and by the User for reasons of User's convenience.
The Site may cancel the sales contract after notifying the User if the supply of the product becomes difficult due to reasons such as stock depletion. In this case, the Site shall refund the payment already received to the User.

[ Article 4 ] Prohibited Acts

Users must not perform any of the following acts when using the Services:

Acts that violate laws or public order and morals
Acts related to criminal activity
Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in the Services or the content of the Services
Acts that destroy or interfere with the functions of the server or network of the Site, other Users, or other third parties
Acts of commercial use of information obtained through the Services
Acts that may interfere with the operation of the Site's services
Acts of unauthorized access or attempts to do so
Acts of collecting or accumulating personal information of other Users
Acts of using the Services for unauthorized purposes
Acts that cause disadvantage, damage, or discomfort to other Users of the Services or other third parties
Acts of impersonating another User
Advertising, promotion, solicitation, or sales activities on the Services not authorized by the Site
Acts of directly or indirectly providing benefits to anti-social forces in relation to the Site's services
Other acts deemed inappropriate by the Site
Acts by a minor User to use the Services without the consent of a guardian

[ Article 5 ] Suspension of Service Provision, etc.

The Site may suspend or discontinue the provision of all or part of the Services without prior notice to the User if the Site determines that any of the following circumstances exist:

When performing maintenance, inspection, or updating of the computer system related to the Services
When the provision of the Services becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster
When the computer or communication line stops due to an accident
Other cases where the Site determines that the provision of the Services is difficult

The Site shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Services.

[ Article 6 ] Restrictions on Use and Deregistration

The Site may, without prior notice, restrict the use of all or part of the Services by a User, or cancel the User's registration, if the User falls under any of the following circumstances:

Violation of any provision of these Terms
Discovery that registered matters contain false facts
Default on payment obligations for fees or other charges
No reply to communication from the Site for a certain period
No use of the Services for a certain period since the last use
Acts that may interfere with the operation of the Site's services

The Site shall not be liable for any damages incurred by the User as a result of acts performed by the Site based on this article.

[ Article 7 ] Disclaimer of Warranties and Limitation of Liability

The Site makes no express or implied warranty that the Services are free from de facto or legal defects (including but not limited to defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, and infringement of rights).
The Site shall not be liable for any damages incurred by the User arising from the Services, except in cases of intentional misconduct or gross negligence by the Site. However, if the contract between the Site and the User regarding the Services (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act, this exemption provision shall not apply.
Even in the case stipulated in the proviso of the preceding paragraph, the Site shall not be liable for damages arising from special circumstances (including cases where the Site or the User foresaw or could have foreseen the occurrence of the damage) among the damages incurred by the User due to default or tort caused by the Site's negligence (excluding gross negligence). Furthermore, compensation for damages incurred by the User due to default or tort caused by the Site's negligence (excluding gross negligence) shall be limited to the amount of the usage fee received from the User in the month in which the damage occurred.
The Site shall not be responsible for any transactions, communications, or disputes that arise between the User and other Users or third parties in relation to the Services.

[ Article 8 ] Changes to Service Content, etc.

The Site may change, add, or abolish the content of the Services with prior notification to the User, and the User shall consent to this.

[ Article 9 ] Changes to Terms of Service

The Site may change these Terms without the individual consent of the User in the following cases:

When the change to these Terms is compliant with the general interests of the Users.
When the change to these Terms does not contravene the purpose of the Service usage contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other circumstances related to the change.

The Site shall notify the User in advance of the intention to change these Terms, the content of the changed Terms, and the effective date, when making a change to these Terms under the preceding paragraph.

[ Article 10 ] Handling of Personal Information

The Site shall appropriately handle personal information obtained through the use of the Services in accordance with the Site's "Privacy Policy."

【 Protection of Personal Information of Minors 】
The Site will handle the personal information of minors appropriately in accordance with this Privacy Policy. If the person is a minor, we may confirm the consent of a parent or guardian regarding the personal information provided, as necessary.

[ Article 11 ] Notices or Communications

Notices or communications between the User and the Site shall be conducted by the method specified by the Site. Unless the User submits a change notification in accordance with a method separately specified by the Site, the Site will assume the currently registered contact information is valid and send notices or communications to that contact, and these shall be deemed to have reached the User at the time of sending.

[ Article 12 ] Prohibition of Assignment of Rights and Obligations

The User may not assign the contractual status under the usage contract or the rights or obligations under these Terms to a third party, or offer them as security, without the prior written consent of the Site.

[ Article 13 ] Governing Law and Jurisdiction

The interpretation of these Terms shall be governed by Japanese law. For any disputes arising concerning the Services, the court having jurisdiction over the location of the Site's head office shall be the exclusive agreed jurisdiction.
